Cabinet Note and GR on SBC reservation 1994

The cabinet note dated 30th November 1994 observed that certain communities in Maharshtra have a tendency to take undue concessions and advantages stipulated for the Scheduled Tribes by procuring forged certificates stating that they belong to Scheduled Tribes category and this tendency is increasing alarmingly with time. The note recommended that the issue pertaining to these communities be referred to Justice Khatri Committee to decide whether a separate category called “Special Backward Classes” should be created and be provided 2% reservation above 50%. Without any report from Justice Khatri Committee in this regard and in a matter of two weeks, the State of Maharashtra issued a GR creating a new category “Special Backward Classes” and granted 2% reservation above 50%. The Case is pending before the Honourable Bombay High Court.
